
Este libro es fruto de un proyecto conjunto de investigación entre los Departamentos de Derecho Penal y Constitucional de la Universidad Externado de Colombia. Su objeto de estudio se centra en los aspectos constitucionales que, producto de los nuevos desarrollos jurisprudenciales y doctrinales, deberían tener en cuenta los operadores jurídicos al momento de resolver los casos judiciales y administrativos en materia penal y disciplinaria. La obra pretende, entre otras cosas, constituir una guía interpretativa de fácil acceso y comprensión para estos operadores que se enfrentan al decantado fenómeno de la constitucionalización de derecho, pero que aún tienen interrogantes acerca de su comprensión. en este sentido, se constituye un "decálogo" académico basado en diez axiomas o silogismos que, a la luz del derecho constitucional, deberían regir la labro jurisdiccional penal y disciplinaria. Este propósito no obsta para que la presente obra pueda ser consultada y estudiada por estudiantes y profesionales del derecho, puesto que también tiene la finalidad de proveer una sencilla aproximación al referido objeto de estudio y brindar una sistematización al respecto.
